GENERAL TERMS AND CONDITIONS OF SALE

It is hereby specified that these conditions exclusively govern sales by Labo Solidago, offered in the WWW.LABOSOLIDAGO.com store.

These conditions apply to the exclusion of all other conditions, particularly those in force for sales in stores or at our resellers.

ARTICLE 1 - PRICES

1.1 - The prices of our products are indicated in dollars for Canada and euros for Europe, excluding participation in processing and shipping costs.

1.2 - All orders, regardless of their origin, are payable in Canadian Dollars for Canada or in Euros for the European Union.

1.3 - Labo Solidago reserves the right to modify its prices at any time and without prior notice, but products will be invoiced on the basis of the tariffs in force at the time of order registration.

1.4 - Retention of title clause: products remain the property of Labo Solidago until full payment of the price by Labo Solidago has been received.

ARTICLE 2 - ORDER

Contractual information is presented in French and will be confirmed, repeating this contractual information, at the latest upon delivery in the form of a commercial invoice. Labo Solidago reserves the right to cancel any order from a customer with whom there is a dispute regarding payment of a previous order. All product photos are non-contractual; packaging and product labels may be changed at any time. Between the validation of your order and the dispatch of your package, the delay can vary from 1 to 5 business days (excluding delivery time).

 

ARTICLE 3 - VALIDATION

When you click on the "Validate my order" button on the "Payment method" page, you declare that you accept it as well as all of these General Terms and Conditions of Sale fully and without reservation. The data recorded by LaboSolidago.com constitute proof of all transactions between Labo Solidago and its customers.

ARTICLE 4 - PRODUCTS AND AVAILABILITY

Our product offers are valid within the limits of available stock. Information comes directly from our suppliers; exceptional errors or modifications are beyond our control and cannot engage our responsibility.

In case of unavailability within the deadlines specified in article 2, after you place your order, we will inform you by email as soon as possible of the cancellation of your order.

In case of unavailability within the deadlines provided for in article 4 and cancellation of the order, reimbursement will be made by credit or via PayPal if this payment method was chosen by the customer when ordering, at the latest within sixty days from the collection of the sums paid by the customer.

Products are presented on LaboSolidago.com with the greatest possible accuracy, using descriptions and visuals. Packaging may undergo modifications or be presented as mock-ups. These visual differences cannot under any circumstances be interpreted as defects of conformity and lead to the cancellation of the sale.

ARTICLE 5 – DELIVERY

5.1 General

Products purchased on Labosolidago.com are delivered internationally. Products are delivered to the shipping address you indicated during the order process. The indicated times are average times and correspond to processing and delivery times.

Labo Solidago cannot be held responsible for consequences due to a delivery delay. Any order not shipped within 30 days of the order may be canceled upon customer request.

Labo Solidago reserves the right to cancel any order that cannot be fulfilled within the foreseen deadlines.

CUSTOMS, DUTIES AND TAXES

Labo Solidago pays taxes (VAT) for France. The international customer has no additional taxation fees to pay.

 When passing through customs, your package may be opened and inspected, which does not alter the quality of the ordered products. Labo Solidago will not issue a refund for a package opened by customs.

We may provide information regarding the order, products and delivery to our international carriers, and they may share this information with customs authorities.

5.2 - Delivery problems

PACKAGE LOSS AND THEFT

We use a shipping method with a tracking number to receive tracking confirmation for the item. The carrier is responsible for successful delivery. We cannot be held responsible for lost or stolen packages. If there is loss or theft, please contact us or the carrier.

ADDRESS ERROR

If your order is returned to us due to an error in the address you entered, the return shipping costs charged to us by the carrier will be charged to you, as well as new shipping costs for re-shipment.

REFUSED DELIVERIES

If you refuse delivery of your order or if the package is returned to us because it was not claimed within the timeframe specified by the transport/delivery service, we will charge you for the return costs incurred by the carrier. We will then contact you regarding this.

 If you wish for your package to be re-sent, we will charge you new shipping fees for the re-shipment.

PACKAGE CONFORMITY

Quebec - Canada

You must check the conformity of the goods delivered at the time of delivery and before signing the delivery note, as your signature on the carrier's delivery slip commits you. Without a precise written description of the damage(s) noted on the receipt: condition of the container and condition of the contents of the package, and products, no recourse will be possible.

You must also confirm non-conformity to the carrier within five business days following receipt of the item(s) and send a copy of this correspondence to Labo Solidago - 82a chemin de la Station, Ste-Anne-de-la-Pocatière, Quebec, Canada G0R 1Z0 or by email.

If the products need to be returned to us, they must be returned within five business days following delivery. Any claim made outside this period will not be accepted.

France/Europe

Your TRACKED package will be delivered by your usual postal delivery service. No signature will be required upon delivery.

5.3 - Conformity or quality

We undertake to exchange products that do not conform to your order (defective or non-compliant, excluding damage related to transport AND order error). You must submit any claim regarding items not conforming to your order (delivery error, non-conformity of products, etc.) with supporting photos, by any means (email or telephone), on the day of delivery or at the latest within 5 business days following delivery.

Example of damage related to transport: damaged seal, damaged bottle, and any damage that may alter the quality of the content.

Claims should be addressed to the contact details specified in article 7 "Customer Service". In your claims, you must indicate the buyer's contact details, your invoice number, the product references on the delivery note, and the reasons for your claim. Any claim made outside this period cannot be accepted.

After reviewing your request, Labo Solidago will proceed with the exchange of the product(s).

Returns of products, in case of product error, will only be accepted for complete products, in their original condition with their original box, and a copy of the purchase invoice.

In the cases referred to in articles 5.2 and 5.3, shipping and return costs will be reimbursed to you.

5.4 - Procedures for exercising the right of withdrawal applicable to the territory of the European Union

The customer can notify their decision to return their product within 5 days of receiving it by means of a clear and unambiguous declaration within 5 days by email.

In the event of a return, the customer must carefully package the item concerned.

The customer is free to choose the shipping method for their product and to subscribe or not to insurance in case of loss, theft or destruction of their package. Labo Solidago does not cover any of these costs nor the cost of transport and cannot be held responsible for the non-receipt of the package.

Labo Solidago advises customers to opt for tracked shipping of the package. In general, all costs and risks associated with the return of the product are the responsibility of the customer.

Only products returned complete, in perfect condition, in their original packaging will be accepted. Otherwise, the return will be considered non-compliant and will not be refunded by Labo Solidago.

Effects of withdrawal – European Union

In the event that the customer complies with the return procedure described above, the refund, excluding actual shipping costs, will be made within 14 days following the date of receipt of the products by Labo Solidago.

Payment for your purchases is made:

- either by credit card online (secure payment by Shopify): Visa, MasterCard, other cards. The card is debited upon placing the order.
